NOTICE OF PASSING OF A ZONING BY-LAW AMENDMENT BY THE MUNICIPALITY OF NORTH PERTH

  • NOTICE OF PUBLIC MEETING FOR A PROPOSED ZONING BY-LAW AMENDMENT

    TAKE NOTICE a statutory public meeting is taking place to discuss a proposed Amendment Zoning By-law affecting the property described above. Pursuant to Section 34 (10.4) of the Planning Act, R.S.O. 1990, c. P.13, the application was deemed complete on August 2, 2024. This Notice is being provided in accordance with the Planning Act (1990) and Ontario Regulation 545/06.

    Purpose and Effect: The subject application is being proposed to satisfy a condition of approval for Consent File B15/24. The severed lot is to be rezoned from Agriculture Zone to Special Agriculture Zone (A-1) to permit a non-farm residential dwelling and associated accessory uses, buildings and structures. 

    The retained lands will be rezoned from Agriculture Zone (A) to Special Agriculture Zone (A-62) to prohibit any new permanent residential dwellings. 

  • NOTICE OF PUBLIC MEETING FOR A PROPOSED ZONING BY-LAW AMENDMENT

    TAKE NOTICE a statutory public meeting is taking place to discuss a proposed Amendment Zoning By-law affecting the property described above. Pursuant to Section 34 (10.4) of the Planning Act, R.S.O. 1990, c. P.13, the application was deemed complete on June 5, 2023.  This Notice is being provided in accordance with the Planning Act (1990) and Ontario Regulation 545/06.

    Purpose and Effect: The property owner wishes to convert the existing institutional building on site to a two-bedroom home. To facilitate this change, a zoning by-law amendment has been requested to change the subject lands from the Institutional (I) zone to the Hamlet/Village Residential (HVR) zone. Site-specific provisions will be required to address a reduction in lot area from 1850 m2 to 620 m2 and a reduction in lot frontage from 24 m to 11.3 m as well as to recognize reduced front and side yard setbacks for the existing building.

    TAKE NOTICE that the Council of The Municipality of North Perth passed By-law No. 79-2024 on the 9th day of September, 2024, under Section 34 of the Planning Act, R.S.O. 1990.

    AND TAKE NOTICE that any person or agency may appeal to the Ontario Land Tribunal in respect of the By-law by filing with the Clerk of the Municipality of North Perth not later than the 3rd day of October, 2024, a notice of appeal setting out the objection to the By-law and the reasons in support of the objection and accompanied by the proper fee.

    TAKE NOTICE that the Council of the Municipality of North Perth passed Development Charge By-law No. 53-2024 on the 26th day of August, 2024, under Section 2 of the Development Charges Act, 1997.

    AND TAKE NOTICE that any person or organization may appeal to the Ontario Land Tribunal under Section 14 of the Act, in respect of the Development Charges By-laws, by filing with the Clerk of the Municipality of North Perth on or before the 7th of October, 2024, a notice of appeal setting out the objection to the By-law and the reasons supporting the objection.     TAKE NOTICE that the Council of the Municipality of North Perth passed By-law No. 52-2024, an Amendment to Development Charges By-law 78-2019, on the 26th day of August, 2024, under Section 19 of the Development Charges Act, 1997.

    AND TAKE NOTICE that any person or organization may appeal to the Ontario Land Tribunal under Section 19 of the Act, in respect of the Amendments to Development Charges By-laws, by filing with the Clerk of the Municipality of North Perth on or before the 7th of October, 2024, a notice of appeal setting out the objection to the By-law and the reasons supporting the objection.   • NOTICE OF COMPLETE APPLICATION FOR A PROPOSED ZONING BY-LAW AMENDMENT

    TAKE NOTICE an application for a Zoning By-law Amendment has been received affecting the property described above. Pursuant to Section 34 (10.4) of the Planning Act, R.S.O. 1990, c. P.13, the application was deemed complete on August 23, 2024. This Notice is being provided in accordance with the Planning Act (1990) and Ontario Regulation 545/06.

    Purpose and Effect:

    The subject application is being proposed to satisfy a condition of Consent File B38-24. The application proposes to rezone the severed lot from Agriculture Zone (A) to Special Agriculture Zone (A-1) to permit a non-farm residential dwelling and associated accessory uses, buildings and structures.

    In addition, the application proposes to rezone the retained lands from Agriculture Zone (A) to Special Agriculture Zone (A-62) to prohibit any new permanent residential dwellings on the agricultural lands.

    TAKE NOTICE that the Council of The Municipality of North Perth passed By-law No. 75-2024 on the 26th day of August, 2024, under Section 34 of the Planning Act, R.S.O. 1990.

    AND TAKE NOTICE that any person or agency may appeal to the Ontario Land Tribunal in respect of the By-law by filing with the Clerk of the Municipality of North Perth not later than the 18th, day of September, 2024, a notice of appeal setting out the objection to the By-law and the reasons in support of the objection and accompanied by the proper fee.

    TAKE NOTICE a statutory public meeting is taking place to discuss a proposed Amendment Zoning By-law affecting the property described above. Pursuant to Section 34 (10.4) of the Planning Act, R.S.O. 1990, c. P.13, the application was deemed complete on July 8, 2024. This Notice is being provided in accordance with the Planning Act (1990) and Ontario Regulation 545/06.

    Purpose and Effect: The requested rezoning will amended the proposed Agricultural parcel from Agriculture (A) to be a Special Agricultural Zone (A-82) to reflect an undersized agricultural parcel.

    Related applications are Consent Application (B24/24) which is to sever the farm parcel from the future plan of subdivision (NP 24-01); and Zoning By-law Amendment file 6-2024 which requests the rezone the lands within the Draft Plan of Subdivision.

    TAKE NOTICE that the Council of the Corporation of the Municipality of North Perth passed Bylaw No. 61-2024 and Bylaw No. 62-2024, on the 12th day of August 2024, under Section 28 of the Planning Act, R.S.O. 1990 as amended.

    AND TAKE NOTICE that any person or agency may appeal to the Ontario Land Tribunal in respect of the By-law by filing with the Clerk of the Municipality of North Perth no later than the 9th day of September, 2024, a notice of appeal setting out the objection to the By-law and the reasons in support of the objection and accompanied by the proper fee.

Notice of Passing of a Zoning By-law by the Municipality of North Perth

TAKE NOTICE that the Council of The Municipality of North Perth passed By-law No. 87-2024 on the 7th day of October 2024, under Section 34 of the Planning Act, R.S.O. 1990, as amended (herein after called the “Act”). Council considered all written and oral submissions received on this application, the effect of which helped Council to make an informed decision.

AND TAKE NOTICE that an appeal to the Ontario Land Tribunal in respect to all or part of this Zoning By-law Amendment may be made by filing a notice of appeal with the Clerk of the Municipality of North Perth either electronically via the Ontario Land Tribunal (OLT) e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service or by mail, no later than 4:30 p.m. on October 29th, 2024. The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal must set out the objection to the By-law, the reasons in support of the objection and must be accompanied by the appeal fee required by the OLT. The appeal fee can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario. Additional information and forms can be found on the OLT website www.olt.gov.on.ca.

PLEASE NOTE notwithstanding the above, subsection 34(19) of the Act identifies the eligible ‘persons’ that may appeal the decision to the Ontario Land Tribunal.

NO PERSON OR PUBLIC BODY shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting, or written submissions to the council, or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

AN EXPLANATION of the purpose and effect of the By-law, and a description of the lands to which the By-law applies, is attached. The complete By-law is available for inspection in the Clerk’s Office during regular office hours.
