NOTICE OF PASSING OF A ZONING BY-LAW AMENDMENT BY THE MUNICIPALITY OF NORTH PERTH

TAKE NOTICE that the Council of The Municipality of North Perth passed By-law No. 87-2024 on the 7th day of October 2024, under Section 34 of the Planning Act, R.S.O. 1990, as amended (herein after called the “Act”). Council considered all written and oral submissions received on this application, the effect of which helped Council to make an informed decision.

AND TAKE NOTICE that an appeal to the Ontario Land Tribunal in respect to all or part of this Zoning By-law Amendment may be made by filing a notice of appeal with the Clerk of the Municipality of North Perth either electronically via the Ontario Land Tribunal (OLT) e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service or by mail, no later than 4:30 p.m. on October 29th, 2024. The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal must set out the objection to the By-law, the reasons in support of the objection and must be accompanied by the appeal fee required by the OLT. The appeal fee can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario.     TAKE NOTICE a Zoning By-law Amendment application has been received affecting the property described above. Pursuant to Section 34 (10.4) of the Planning Act, R.S.O. 1990, c. P.13, the application was deemed complete on October 4, 2024. This Notice is being provided in accordance with the Planning Act (1990) and Ontario Regulation 545/06.

    Purpose and Effect: The subject application is proposing to rezone the property from Residential Zone 3 (R3) to Special Residential Zone 3 (R3-6). The requested amendment will allow for the reduction of the minimum rear yard depth (Section 9.2.6) from 7.5 metres to 5.5 metres to facilitate the construction of main floor decks above a rear walkout. 

  • NOTICE OF PUBLIC MEETING FOR A PROPOSED ZONING BY-LAW AMENDMENT

    TAKE NOTICE a statutory public meeting is scheduled to discuss a proposed Zoning By-law Amendment affecting the property described above. The requested relief is required to satisfy a condition of Consent Approval B12-24.

    PURPOSE OF APPLICATION: The subject application is requesting relief from Section 7.26 of the North Perth Zoning By-law to reduce the minimum requirement for rear yard depth from 7.5 m (25 ft) to 5.7 m (18.7 ft) to permit the construction of a covered deck at the rear of the existing dwelling. 

     

  • NOTICE OF PUBLIC MEETING FOR A PROPOSED ZONING BY-LAW AMENDMENT

    TAKE NOTICE a statutory public meeting is taking place to discuss a proposed Amendment Zoning By-law affecting the property described above. Pursuant to Section 34 (10.4) of the Planning Act, R.S.O. 1990, c. P.13, the application was deemed complete on August 23, 2024.  This Notice is being provided in accordance with the Planning Act (1990) and Ontario Regulation 545/06.

    Purpose and Effect: The subject application is being proposed to satisfy a condition of Consent File B38-24. The application proposes to rezone the severed lot from Agriculture Zone (A) to Special Agriculture Zone (A-1) to permit a non-farm residential dwelling and associated accessory uses, buildings and structures. 

    In addition, the application proposes to rezone the retained lands from Agriculture Zone (A) to Special Agriculture Zone (A-62) to prohibit any new permanent residential dwellings on the agricultural lands.

This Notice is being provided in accordance with the Planning Act (1990) and Ontario Regulation 545/06.

    Purpose and Effect: The subject application is being proposed to satisfy a condition of approval for Consent File B15/24. The severed lot is to be rezoned from Agriculture Zone to Special Agriculture Zone (A-1) to permit a non-farm residential dwelling and associated accessory uses, buildings and structures. 

    The retained lands will be rezoned from Agriculture Zone (A) to Special Agriculture Zone (A-62) to prohibit any new permanent residential dwellings.

PLEASE NOTE notwithstanding the above, subsection 34(19) of the Act identifies the eligible ‘persons’ that may appeal the decision to the Ontario Land Tribunal.

NO PERSON OR PUBLIC BODY shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting, or written submissions to the council, or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

AN EXPLANATION of the purpose and effect of the By-law, and a description of the lands to which the By-law applies, is attached. The complete By-law is available for inspection in the Clerk’s Office during regular office hours.
